Terms of Service for Churchfeed

1. Introduction

Welcome to Churchfeed (the "Platform"), a community for Christian designers to share their creative work and inspire others. These Terms of Service ("Terms") govern your access to and use of our Platform, including any content, functionality, and services offered.

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Platform.

2. Eligibility

You must be at least 13 years of age to use our Platform. By using the Platform, you represent and warrant that you meet this eligibility requirement.

3. User Accounts

3.1 Registration

To access certain features of the Platform, you may be required to register for an account. When you register, you agree to provide accurate, current, and complete information.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. User Content

4.1 Ownership

You retain all ownership rights to the content you submit to the Platform ("User Content"). By submitting User Content, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, distribute, modify, adapt, prepare derivative works of, display, and perform your User Content in connection with the Platform and our business.

4.2 Social Media and Promotional Use

By submitting User Content to the Platform, you also grant us permission to use your content for our social media accounts, marketing, and promotional purposes. If you wish to opt out of having your content used for these purposes, you must email info@churchfeed.net with your request. Please note that we will make reasonable efforts to honor opt-out requests, but content that has already been used may remain in circulation.

4.3 User Content Representations and Warranties

You represent and warrant that:

• You own or have the necessary rights, licenses, and permissions to submit the User Content and to grant the rights described in these Terms.
• Your User Content does not infringe or violate any third-party rights, including intellectual property rights, privacy rights, or publicity rights.
• Your User Content complies with all applicable laws and regulations.
• Your User Content is consistent with the values and principles of the Christian faith, as generally understood within the broader Christian community.

4.4 Content Monitoring

We do not actively monitor User Content but reserve the right to review and remove any User Content that violates these Terms or that we find objectionable for any reason, without prior notice.

5. Prohibited Conduct

You agree not to:

• Use the Platform in any way that violates any applicable law or regulation.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Upload, post, or transmit any User Content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
• Upload or transmit any material that contains viruses, Trojan horses, worms, or any other malicious code.
• Attempt to gain unauthorized access to any portion of the Platform or any systems or networks connected to the Platform.
• Use the Platform to advertise or offer to sell goods or services except as expressly permitted by us.
• Use automated means, including spiders, robots, crawlers, or data mining tools, to download data from the Platform.
• Circumvent, disable, or interfere with security-related features of the Platform.

6. Intellectual Property Rights

6.1 Platform Content

All content on the Platform not submitted by users, including text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of Churchfeed or its content suppliers and is protected by copyright, trademark, and other intellectual property laws.

6.2 Copyright Infringement

We respect the intellectual property rights of others. If you believe that your copyright has been infringed on the Platform, please provide us with a written notice containing the following information:

• An electronic or physical signature of the person authorized to act on behalf of the copyright owner.
• A description of the copyrighted work that you claim has been infringed.
• The URL of the location on our Platform containing the material that you claim is infringing.
• Your address, telephone number, and email address.
• A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
• A statement by you that the information in your notice is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

7. Disclaimer of Warranties

THE PLATFORM AND ALL CONTENT AND SERVICES PROVIDED THROUGH THE PLATFORM ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

WE DO NOT WARRANT THAT THE PLATFORM WILL FUNCTION UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE PLATFORM OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

8. Limitation of Liability

IN NO EVENT WILL WE, OUR AFFILIATES, OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

THE FOREGOING DOES NOT AFFECT ANY LIABILITY WHICH CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE OR FOR FRAUD OR FRAUDULENT MISREPRESENTATION.

9. Indemnification

You agree to defend, indemnify, and hold harmless Churchfeed, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Platform, including your User Content.

10. Governing Law and Jurisdiction

10.1 UK Users

These Terms shall be governed by and construed in accordance with the laws of England and Wales. You and we irrevocably agree that the courts of England and Wales shall have non-exclusive jurisdiction to settle any dispute which may arise out of, under, or in connection with these Terms or your use of the Platform.

10.2 International Users

If you access or use our Platform from outside the United Kingdom, you are responsible for compliance with your local laws, if and to the extent local laws are applicable. Nothing in these Terms limits our right to comply with law enforcement or other governmental or legal requests or requirements relating to your use of the Platform or information provided to or gathered by us with respect to such use.

11. Modifications to the Platform and Terms

We reserve the right to modify or discontinue the Platform at any time without notice. We may also revise these Terms from time to time. The most current version will always be posted on our Platform. By continuing to access or use our Platform after revisions become effective, you agree to be bound by the revised Terms.

12. Termination

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms.
